Green claims: obligations and prohibitions

Green claims: obligations and prohibitions CONAI has published “Green claims: obligations and prohibitions. A brief guide to the new European Directive 2024/825/EU” .

In recent years, attention to sustainability and transparency in corporate communications has taken on an increasingly central role in the European context. The need to ensure correct information to consumers, avoiding misleading practices such as greenwashing, has led the European legislator to intervene with new regulatory provisions.

Directive 2024/825/EU, known as “Empowering Consumers for the Green Transition”, fits into this scenario.

It represents a fundamental step towards greater clarity and responsibility in communication on labels and beyond. It also introduces measures that require companies to be more precise and transparent in their “green claims”.

This overview document of the provisions currently in force offers a practical guide to align with the regulatory requirements that will be implemented in Italian law by 27 March 2026 .

Knowing and understanding the contents of the directive now will allow companies to gradually adapt, facilitating the transition towards clearer communication towards the consumer.

Directive 2024/825 amended Annex 1 of Directive 2005/29/EC (Unfair Commercial Practices Directive) which lists practices that are always prohibited.
